New and changing policies target the built environment — one of the largest sources of greenhouse gas (GHG) emissions. Energy efficiency targets, emissions limits, and compliance reporting requirements for commercial and multifamily buildings are complex with real cost implications for non-compliance. NYC Local Law 97
Filing Deadline: May 1 Annually
Carbon emission limits for buildings over 25,000 sq. ft. Learn new updates with guidance on electrification incentives and exemptions. Penalties apply for non-compliance.

Washington State Clean Buildings Act
Filing Deadline: June 1, 2026 
Commercial buildings over 50,000 sq. ft. Energy Use Intensity (EUI) targets or follow an approved “investment criteria” pathway. Early adopters may qualify for incentive programs -- benchmarking is a first critical step.

Maryland BEPS
Building Energy Performance Standards 
3rd-Party verification required for 2025 data submitted by June 1, 2026
Commercial and multifamily 35,000 sq. ft. or more. Annual benchmarking began 2025 with carbon reduction enforcement by 2030 with non-compliance penalties. New incentives expected summer 2026.

Cambridge, MA Building Energy Use Disclosure Ordinance (BEUDO)
Annually report prior year's energy and water use May 1.
Large Buildings 100,000 sq. ft or more, and mid-sized buildings 25,000-100,000 sq ft. have emission reduction targets phased in from 2026. Non-compliance penalties apply.

Colorado's BPS
Annual Benchmarking Deadline: June 1
Buildings 50,000 sq. ft. or more require 7% emissions reductions every 5 years with stricter targets 2026-2030. Electrification and renewable incentives expanding. Non-compliance penalties apply.

Energize Denver
Annual Benchmarking Deadline: June 1
Buildings 25,000 sq. ft. or more. Aggressive EUI targets and electrification requirements. New rebates to support compliance for smaller buildings. Non-compliance penalties apply.

 Boston’s Building Emissions Reduction and Disclosure Ordinance (Berdo)
Emissions Limits Began 2025
Buildings over 35,000 sq. ft. or 35+ units. Emissions intensity limits with increasing stringency through 2030.

 Oregon Building Performance Standard
(HB 3409)
Benchmarking Began: January 2025
Compliance Window: 2028-3030
Nonresidential, multifamily, schools, hospitals 35,000 sq. ft. or more, hotels/motels 20,000 sq. ft. or more. Energy performance targets and reporting to Oregon Department of Energy. Failure to comply may result in escalating administrative fines.
